1. Acceptance of Terms

By accessing or using the Lumé platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Lumé ("Company", "we", "us", or "our").

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We reserve the right to request proof of age at any time and to terminate accounts that violate this requirement.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Creator Accounts

Creators are solely responsible for the content they upload and distribute through the platform. By becoming a creator, you represent that you own or have the necessary rights and licenses to all content you publish. You grant Lumé a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely for the purpose of operating the Service.

5. Subscriber Accounts

Subscribers pay a recurring fee set by the creator to access exclusive content. Subscription fees are billed in advance on a monthly basis. By subscribing, you authorize us to charge your payment method for the subscription fee. Subscriptions auto-renew unless cancelled before the next billing cycle.

6. Payments & Refunds

All payments are processed through secure third-party payment processors. Lumé retains a platform fee from each transaction as described in our creator agreement. Refunds are handled on a case-by-case basis. Chargebacks made in bad faith may result in account suspension or termination.

7. Prohibited Content & Conduct

You may not use the Service to:

• Upload, distribute, or promote content involving minors in any capacity.
• Share content that promotes violence, hatred, harassment, or discrimination.
• Engage in fraud, phishing, or other deceptive practices.
• Upload malware, viruses, or other harmful software.
• Violate any applicable local, state, national, or international law.
• Impersonate any person or entity, or misrepresent your affiliation.
• Scrape, harvest, or collect data from the Service without authorization.
• Redistribute, resell, or publicly share content obtained through subscriptions.

8. Intellectual Property

All intellectual property rights in the Service (excluding user content) are owned by Lumé. You may not copy, modify, distribute, or reverse-engineer any part of the Service. Creators retain all intellectual property rights to their content. Subscribers may not reproduce, redistribute, or commercially exploit creator content without explicit written permission from the creator.

9. Content Moderation

We reserve the right to review, remove, or disable access to any content that violates these Terms or is otherwise objectionable, at our sole discretion. We may also suspend or terminate accounts that repeatedly violate our policies. We are not obligated to monitor all content but may do so at our discretion.

10. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We are not responsible for the accuracy, reliability, or completeness of any content posted by users.

12. Limitation of Liability

To the fullest extent permitted by law, Lumé shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of or inability to use the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Lumé operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration.

14. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of material changes through the Service or via email. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
